Please understand that this web site is intended for photo buyers, i.e., those who are interested in paying a fee to use our images for a certain period of time. These images are NOT FREE. These images are NOT PUBLIC DOMAIN.


Licensing Requests

    In order for use to quote a licensing fee, we need to know specific details of your intended use of our image(s), including: advertising/editorial, medium (e.g., text book, magazine, brochure, postcard/calendar, annual report, wall display, web site, CDROM, etc.), print run (how many copies of the product will be produced), rights (regional/domestic/worldwide, nonexclusive/first/exclusive, etc.), time period (six months, three years, one time, etc.), delivery (duplicate film, original film, 20MB digital file, drum scan, etc.).

Image Delivery

    All images on this site are JPEGs, compression-optimized to keep the primary subject relatively sharp while reducing file size and download time. For their on-screen size (5" in the maximum dimension) these JPEGS are quite small (10-18kb) and, where it counts, sharp, but please bear in mind that background detail is intentionally allowed to go soft.

    Image scans can be provided on CD, Iomega Zip Drive 100, via email or via FTP (file transfer protocol). They can be stored in any format compatible with Photoshop or Illustrator, including JPEG, TIFF, Bitmap, GIF, etc. 70mm and 35mm duplicate transparencies, and in some cases internegatives, are available. Originals are available by negotiation.

    We encourage you to browse through the hundreds of photographs in this site. Please understand that they are NOT FREE -- they may be licensed for a negotiable fee. The content of this site is made available for purposes of researching or licensing images offered by Phillip Colla Photography. No image is to be copied, duplicated, modified or redistributed in whole or part without the prior written permission from Phillip Colla Photography.

    Our livelihood as photographers and videographers is predicated upon making photographic and videographic images and licensing rights to use those images. Please know that these images are costly to produce and that we do not give away their use. Please respect domestic and international copyright law, and understand that copyright law is what makes professional photography possible and protects a photographer´s ability to market his own creations. It is for these reasons, and the tendancy on the internet for images to be copied without compensation or credit, that we do not make images available on our site at sizes larger than 144 x 216 without special arrangement.

Humpback whale photographs were taken, and are used, under the provisions of National Marine Fisheries Service research permits 633 and 882. No image may used, for any purpose other than temporary caching by web browsers, without prior written permission from Phillip Colla Photography. While the content of this site is deemed accurate, it is neither legally binding nor guaranteed. Phillip Colla Photography is not responsible for improper use of the material (text, images) contained in this site. The entire content of this site, as a whole and in its parts, is protected by international copyright.

Web Site Use

    Web site use (i.e., OUR image(s) appearing on YOUR site) is no different that any other use -- it requires a licensing fee and a properly executed licensing agreement. We do not allow display of our images in exchange for a credit line and/or a link only, regardless of the orientation of the web site in question (e.g., educational, non-profit, charity, personal, etc.) -- the display must be accompanied by a fee and agreement.

Student Questions About Our Photographic Subjects

    Since this site was first published on the web, we have received thousands of questions from students worldwide regarding the natural history of our animal subjects. Regrettably, in general we can no longer respond personally to student questions sent by email, as it simply takes too much time to answer questions properly. Furthermore, while the internet and web are powerful avenues of communication, it is our strong opinion that students rely on the web overly much for their research needs. Proper academic research must begin at the library -- i.e., with BOOKS and JOURNALS. Good research requires consultation of peer-reviewed scientific papers, lay articles in the popular press, and consideration of encyclopedia, guide and text books. The vast majority of published scientific and academic reports is still available only in printed form, and although the content of the web is growing quickly, these reports may never be available online except in the form of abstracts.

    In some cases we have presented links to other sites that we feel will be helpful to students doing research.

Student Requests to Use / Borrow / Take Our Web Site Images

    We also receive numerous requests from students and well-meaning organizations to use our images in school reports and on school or personal web sites. Please know that these images are costly to produce and that we do not give away their use. Please respect domestic and international copyright law, and understand that copyright law is what protects a photographer´s ability to market his own creations. It is for these reasons, and the tendancy on the internet for images to be rampantly copied without compensation or credit, that we do not make images available at sizes larger than thumbnails without special arrangement.

    WEB SITES: We do NOT allow our photographs to be copied to or displayed on a web site (educational, non-profit, personal or otherwise) without a licensing fee and properly executed licensing agreement. Please contact us if you wish to license one of our images for your site.

    PRINTED REPORTS: Teachers please note that our images do NOT fall under any "fair use" law, unless you have purchased a text book that includes the image. Students may use the thumbnail images (JPEG files) appearing on our site (www.Gygis.com), in their PRINTED REPORTS ONLY, provided all of the following are met:

      The image is not altered in any way. In particular, this means that the name and URL stamped on the image are not altered.

      The image is reproduced in print only, as part of an academic report, for one-time distribution in a classroom setting ONLY. No distribution other than this is authorized. Use on the internet or web is specifically NOT allowed.

      Proper acknowledgement of the photographer is included in the report, with a statement similar to "ABCXYZ images courtesy / copyright Phillip Colla Photography, all rights reserved worldwide."

    If all three stipulations are not met, the use is not authorized.
